Laws Regarding The Release Of Covenant?

We are trying to re-mortgage our premises and have recently been granted planning permission including the development of a bar / restaurant.

The problem is that the finance company will not release funds due to a covenant placed on the building many years back by a local brewery. The covenant restricts the opening of any further licenced premises within a certain radius.

Clearly most of these breweries have moved on but the covenant still exists which the finance company has stated will effect the value of the building.

Can the brewery set the figure to release the covenant, if so are there any laws which prevents them from taking advantage of the situation?
